This End User License Agreement (“EULA”) constitutes a valid and binding agreement between you, as the end-user, and Neirfeno Limited (SC514019), registered in Scotland at 45 Rankine Street, Dundee, DD3 6DY, for the use of the Snappy Staff mobile application (the “App”). Please review the EULA carefully before downloading, accessing or using the App.
1. Acknowledgment
By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, you must immediately uninstall the App and discontinue its use.
2. License
Subject to the terms of this EULA, Neirfeno Limited grants you a non-exclusive and non-transferable licence to download, install, and use the App for your personal and non-commercial use on a mobile device owned or controlled by you.
3. Restrictions on Use
You agree not to, and will not permit others to: (a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party; (b) copy or use the App for any purpose other than as permitted in Section 2; (c) remove or alter any proprietary notices or labels on the App.
4. Intellectual Property
The App, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of Neirfeno Limited.
5. Privacy
Your use of the App is subject to Neirfeno Limited’s Privacy Policy, which is available at https://snappystaff.com/privacy-policy (as may be updated from time to time).
6. Changes to This EULA
Neirfeno Limited reserves the right to modify this EULA at any time, and without prior notice, by posting an amended EULA that is always accessible through the App. Your continued use of the App indicates your acceptance of the amended EULA.
7. Termination
This EULA will continue to be in force until the earlier (a) termination by you (by ceasing to use the App), or (b) termination by Neirfeno Limited. Upon termination of this EULA, you must discontinue all use of the App and promptly uninstall and delete all copies of the App.
8. Disclaimers
The App is provided “AS IS” and “AS AVAILABLE” basis. Neirfeno Limited disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
In no event will Neirfeno Limited be liable for any indirect, special, incidental, or consequential damages, that are directly or indirectly related to the use of, or the inability to use, the App, even if Neirfeno Limited has been advised of the possibility of such damages.
10. Governing Law
This EULA will be governed by and construed in accordance with the laws of Scotland, without regard to conflict of law principles.
By using the App, you confirm that you accept this EULA and that you agree to comply with them.
